General Terms of Use
Last updated: October 28, 2026 · Contact: contact@cartia.fr
1. Purpose
These general terms of use and sale (hereinafter the “Terms”) govern access to and use of the Cartia platform available at cartia.fr (hereinafter the “Service”), published by the publisher identified in the legal notice (hereinafter “Cartia”, “we”).
Rationalab is, like Cartia, a name and a business of Shams Factory. It is not a separate company: same legal entity, same SIRET. Only Chhaju Chakma, sole proprietor (entrepreneur individuel) (trade name Shams Factory), is the publisher of the Service, the contracting party and the holder of the legal obligations (billing, the Terms, DPA).
Cartia provides digital loyalty SaaS software for merchants: creation of a program (stamps or points), customer enrollment via QR code, a digital card viewable on a phone, scanning at the counter (web or the Cartia Counter app), a dashboard and related tools.
By creating an account or using the Service, the merchant (hereinafter the “Customer”, “you”) accepts these Terms. If you do not accept these terms, you must not use the Service.
2. Definitions
- Account: personal space giving access to the Service (organization, shops, programs, team).
- End Member: a customer of the merchant enrolled in the loyalty program through the enrollment flow (QR / link).
- Organization: business entity managed in Cartia, holder of the subscription and of the program data.
- Plan: pricing offer (Free, Pro or Business) determining the quotas and features available.
3. Account and access
Registration requires accurate and up-to-date information (identity, email, organization details). You are responsible for the confidentiality of your credentials and for the activity carried out from your Account.
You must notify Cartia without delay of any suspected unauthorized use (contact@cartia.fr). Cartia may suspend or restrict an Account in the event of suspected abuse, non-payment, breach of the Terms or a risk to the security of the Service.
The Service is intended for professionals. You warrant that you have the authority necessary to bind the Organization concerned.
4. Description of the Service
Depending on the Plan subscribed, the Service may include, in particular:
- creation and publication of a loyalty program (stamps or points);
- generation of QR materials / posters for enrollment in the shop;
- digital loyalty card for End Members (viewable on a phone, without a mandatory customer app);
- EARN / REDEEM scan at the counter via Cartia Counter;
- dashboard (indicators, customers, settings);
- GDPR tools on the merchant side (export and anonymization of End Member records).
Digital card and Wallet. End Members add their card through the QR flow, with direct addition to Apple Wallet and Google Wallet. The Service includes the generation and updating of these passes within the limits of technical constraints and of the terms of the Apple and Google platforms.
5. Plans, pricing and trial
Unless otherwise indicated at the time of the order, the Plans are as follows:
- Free: €0 - up to 50 End Members, 1 shop / 1 program, no credit card required to get started;
- Pro: €29.90 / month, tax included - unlimited End Members (within reasonable technical limits), 1 shop / 1 program - 14-day trial on paid Plans under the terms displayed;
- Business: €59.90 / month, tax included - unlimited End Members (within reasonable technical limits), 3 shops / 3 programs included - 14-day trial under the terms displayed.
- Additional location (Business Plan only): €10 / month, tax included, per location beyond the included quota, added or removed at any time from the dashboard. Each additional location opens one more shop and one more program. Billing is prorated over the current period and the add-on is added to the Plan price for the following periods. The total number of locations that can be managed from the Service is capped at 50; beyond that, a specific agreement is required.
The prices, quotas and inclusions displayed in the Service or on the pricing page prevail in the event of any discrepancy with older marketing material. Cartia may change the Plans; price changes applicable to existing subscriptions are communicated within a reasonable time before they take effect.
At the end of a trial that is not converted, or upon expiration / termination of a paid Plan, access to paid features may be restricted (including scanning), in accordance with the Service’s entitlement rules.
6. Payment and billing (Stripe)
Paid Plans are billed through the payment provider Stripe. By subscribing, you accept the processing of your payment data by Stripe under its own terms. Cartia does not store full bank card numbers.
Unless otherwise stated, subscriptions renew automatically at the end of each period until terminated or until the Plan is changed through the flows offered in the Service. In the event of a payment failure, Cartia may suspend all or part of the Service after reasonable notice.
The amounts displayed are the amounts due, in euros, with no tax added at checkout (Free €0, Pro €29.90 / month, Business €59.90 / month, additional location €10 / month). VAT not applicable, article 293 B of the French General Tax Code (CGI).
Subscription pause. The Account holder may pause a paid Plan from the dashboard, with or without a resumption date. During the pause, no charge is made and the Service is suspended (counter visits, new sign-ups, campaigns); data and cards already installed are kept. Time already paid for and not used on the day the pause begins is set aside: it is not refunded, but is returned on resumption by postponing the next due date, provided the pause lasted at least 7 days. A shorter pause has no effect on the due date. A pause lasts 12 months at most: if the subscription is not resumed, and after a warning sent at least 30 days beforehand, the subscription is terminated and the time set aside is lost. The same applies if the subscription is terminated during a pause.
7. Customer’s obligations (merchant)
You undertake in particular to:
- use the Service in compliance with the law, these Terms and the rights of third parties;
- define and clearly communicate the rules of your loyalty program (thresholds, rewards, exclusions) to your End Members;
- remain responsible for the commercial relationship with your End Members, including the marketing communications you choose to send;
- collect the consents required where regulations so require, including for Wallet notifications and marketing emails;
- not use the Service for unlawful or misleading content, or content that infringes the rights of others;
- not attempt to circumvent quotas, security measures, rate limits or access controls.
Cartia acts as a technical provider. You are responsible for the content of your program, your materials (posters, QR codes) and the commitments made to your customers.
8. Data and privacy
The processing of personal data is described in the privacy policy. For End Members’ data collected as part of your program, you act in principle as data controller; Cartia acts as a technical data processor for the hosting and operation of the Service, under the data processing agreement (DPA), except where Cartia alone determines the purposes (e.g. billing of your SaaS subscription, platform security). Application data is hosted in Germany (Hetzner Cloud, EU).
In presenting its commercial references, Cartia may publish the trade name, shop sign or logo of merchants using the Service, in accordance with the conditions set out in article 10.
Where these elements include personal data, in particular where they make it possible to identify a natural person carrying on a professional activity, their processing is carried out in accordance with the applicable personal data protection rules and with the information detailed in Cartia’s privacy policy.
9. Availability, maintenance and changes
Cartia endeavors to provide reasonable availability of the Service. Interruptions may occur (maintenance, incidents, force majeure, third-party dependencies). No 100% availability is guaranteed.
Cartia may change the Service (features, interfaces, API) to improve security, compliance or the product experience. Substantial changes likely to adversely affect day-to-day use are communicated where possible.
10. Intellectual property and commercial references
10.1 — Cartia’s intellectual property
The Service, its software, trademarks, interfaces and documentation remain the property of Cartia or its licensors.
No transfer of rights is granted beyond the limited, non-exclusive, non-transferable license of use necessary to use the Service for the duration of the contract.
10.2 — Ownership of the Customer’s content
The Customer retains all of its rights in the content it provides or uploads to the platform, including in particular its trade name, shop sign, logo, loyalty program texts and other elements of its commercial identity.
The Customer grants Cartia a non-exclusive license, limited to the hosting, technical reproduction and processing of that content to the extent necessary to provide the Service.
10.3 — Authorization for use as a commercial reference
By accepting these Terms, the Customer authorizes Cartia, on a royalty-free and non-exclusive basis, for the duration of the contractual relationship and worldwide given the international accessibility of digital media, to reproduce, represent and communicate to the public its trade name, corporate name, shop sign and official logo, solely in order to present the Customer as a user or customer of the Service.
This authorization also covers the trade names of the locations attached to the Customer’s Organization.
It allows Cartia in particular to display these elements:
- on the website cartia.fr and the other official websites operated under the Cartia brand;
- in sections presenting merchant users, such as “They use Cartia”, “Our merchants” or “They trust us”;
- in unsponsored publications of Cartia’s official accounts on Instagram, Facebook, LinkedIn and TikTok, when their purpose is to present merchants using the Service.
Where the Customer has no logo, Cartia may present only its trade name or shop sign.
The use of these elements must remain faithful to the Customer’s identity and to the reality of its commercial relationship with Cartia.
It must not suggest that the Customer particularly recommends, certifies or endorses the Service, nor that there is an official partnership distinct from the actual commercial relationship.
Logos may be resized or technically adapted to the formats of the media, provided their essential characteristics are not altered.
This authorization does not entail any transfer of intellectual property to Cartia.
10.4 — Rights in the elements communicated
The Customer represents that it is authorized to grant the uses provided for in article 10.3, including with regard to any third-party rights in the logos and graphic elements concerned.
Where an element belongs to a third party or is subject to use restrictions, the Customer undertakes to inform Cartia.
In the event of serious doubt as to the rights to use an element, Cartia may suspend its publication pending clarification or an appropriate authorization.
10.5 — Right to refuse and to withdraw
The Customer may at any time refuse to appear among Cartia’s commercial references or request the removal of its trade name, shop sign or logo.
This request may be made free of charge and without justification, by contacting Cartia at contact@cartia.fr.
Cartia undertakes to take the request into account and to remove the references concerned from its websites and from its publications on the social networks it controls, within a maximum of ten (10) business days of receipt, subject to any legal obligation imposing a shorter period.
Refusal or a request for removal has no effect on the subscription, the features or the Customer’s use of the Service.
Cartia cannot guarantee the deletion of copies, shares, archives or content already reproduced by third parties independent of its will.
10.6 — Duration and limits of the authorization
The authorization provided for in article 10.3 is valid for the duration of the contractual relationship and ends in the event of a withdrawal request by the Customer or of definitive termination of the contract.
Upon the end of the authorization, Cartia ceases any new use and removes the references still accessible on the media it controls, under the conditions set out in article 10.5.
This authorization does not cover, without a specific agreement, the use of photographs of recognizable persons, testimonials attributed to the Customer, videos made on its premises, sponsored advertising campaigns, or any use suggesting a particular endorsement of Cartia.
Any processing of personal data associated with these references is carried out in accordance with applicable law and with Cartia’s privacy policy.
11. Liability
The Service is provided “as is” for professional use. To the extent permitted by law, Cartia cannot be held liable for indirect damages (loss of revenue, of clientele, of data not attributable to Cartia, reputational harm) or for business decisions made on the basis of the dashboard indicators.
Cartia’s total liability under these Terms, for one event or a series of related events, is limited, except in the case of gross negligence (faute lourde) or willful misconduct (dol), to the amount actually paid by you to Cartia under the relevant Plan during the twelve (12) months preceding the triggering event - or to zero euros if you are only on the Free Plan.
You remain solely responsible for the rewards promised to your End Members and for honoring them in the shop.
12. Term, termination and effects
The contract takes effect upon creation of the Account and continues for the duration of the chosen Plan. You may stop using the Service or request closure of your Account by contacting contact@cartia.fr (or through the flows available in the product, where applicable).
Cartia may terminate or suspend the Service in the event of a serious breach that is not remedied, non-payment, unlawful use or a risk to the platform. Upon termination, access to the Service ends; data is kept or deleted in accordance with the privacy policy and legal obligations.
If Cartia plans to permanently shut down, we commit to notifying each merchant and emailing them an export of their customer records and available loyalty balances before closure, regardless of their plan. Delivery is made to the account owner’s address after verifying the recipient, through an encrypted file or a secure link.
Cards already installed in Apple Wallet and Google Wallet may stay on customers’ phones; scanning, updates and operation of the program through Cartia depend on the service remaining available.
13. Changes to the Terms
Cartia may modify these Terms. The version in force is published on this page with its update date. For Customers with an active Account, material changes are notified by reasonable means (email or notice in the Service). Continued use after the changes take effect constitutes acceptance, unless the law provides otherwise.
By way of exception, any new provision or extension of the rights authorizing Cartia to reproduce or use a Customer’s trade name, shop sign or logo for communication or commercial-reference purposes requires, for Customers who accepted an earlier version of the Terms, express acceptance of the new provisions or a separate agreement.
Failure to respond to a notice of change does not, in itself, constitute an authorization of these new uses.
14. Governing law and disputes
These Terms are governed by French law. In the event of a dispute, and failing an amicable settlement, jurisdiction is vested in the competent French courts, subject to the applicable rules of public policy.
